The Governing law and Jurisdiction is the Superior Court for Baja California located in Tijuana, Mexico for any
action you may bring arising from a tort or negligence. You agree

Mexico law without giving effect to any principles of conflicts of laws.
YOU FURTHER AGREE, that Medicina has the right to file an action against you in any jurisdiction outside of Mexico if a
chageback exists on your credit card.
You further agree to pay our attorney's fees. Once a action is filed the
attorney's fees are set at $2,500.00 U.S. dollars not including court fees. You further agree to pay all travel
expenses and all related costs in trial discovery including but not limited to hotels, food and other related costs.
Our credit card processor is BBV Bancomer charges $100.00 per chargback and you agree to pay this sum for
any and all chargebacks that we receive as a result of your bank refusing to pay Medicina.

Medicina, and Medicina has no obligation to re-ship or refund any consumer who has violated their local law

The terms and conditions applicable to any product, service or information will be those determined at the time
of provision of the product, service or information. Please be aware of the laws of your jurisdiction or
that otherwise apply to you in relation to any of the matters described in these pages.
If you choose to access this Web Site from outside of the Country of Mexico, you do so on your own initiative and you
are responsible for compliance with applicable laws of your own country. Medicina is not responsible if you resale our
medications or export them to any other country.

International Orders, Prices, Payment Terms, Interest and Credit Cards
The prices for the products and services on this Web Site are quoted, for convenience, in United States dollars, but can
be charged in Mexican Pesos or other currencies and shall be as set forth in this Web Site as at the time of acceptance
of an order by Medicina Mexico.
Prices for Products shall be subject to change without any further notice.
Medicina Mexico offeres no Credit terms. All sales are final and are payable in cash or by credit card. Mexican law
requires Medicina to issue Mexican Invoices to Mexican companies and Mexican citizens who have a valid Mexican RFC number.
Medicina
All credit card payments are processed immediately at Checkout in real time when using our web pages. When contacting us
via E-Mail or by telephone to place your order, we will charge your credit card that day.
Our credit cards are processed by BBV Bancomer in Mexico and are always subject to approval.
We normally ship within 24 hours of payment, however sometimes we have to order your medication from our distributor and
this will delay the time it takes for you to receive it. Because of same day payment processing, orders cannot be cancelled.
The Mexican Government will not allow Medicina, or for that matter any licensed Mexican Pharmacy to accept any medication
for a return once sold and received by the customer.
There are no exceptions. This rule was set by
the Mexican Government for health and security purposes.
You hereby agree to pay attorney fees that Medicina Mexico has as a result of any chargback fees arising from your credit card. You further agree that you will pay all hat any chargebacks that Medicina receives regarding your credit card
Any disputes about Credit Card billing must be discussed with Medicina Mexico before contacting your Credit Card provider. If making payment by Credit Card, you agree not to initiate a "Charge back" dispute against Medicina Mexico for any reason.
If you violate this agreement, You waive the right to jurisdiction for collections to any city where your credit card was issued, or where you reside or work. In short, we can decide the jurisdiction in order to prosecute you.
Further, we will disable your account and deny any future product orders from you. You further agree to reimburse Medicina Mexico for any costs associated with a charge back which may be charged by BBV Bancomer.
Consequences
Medicina Mexico reserves the right to suspend or terminate your account if you violate the Terms of Use Agreement. If your violation causes harm to others, you agree to indemnify and hold Medicina Mexico harmless from and against any and all loss, damage, or expense. If any dispute arises between us regarding this Agreement or your use of this Web Site, it shall be resolved through good faith negotiations between the parties.
If such efforts prove unsuccessful, all such controversies, claims, or disputes shall be submitted to binding arbitration pursuant to the law and regulations of the State of Baja California. Arbitration shall be conducted in accordance with the rules of the Mexican Court. The arbitration award shall be final and binding, and it may be confirmed and enforced in any court of competent jurisdiction. Each party shall pay for all attorney fees it incurred in connection with the arbitration and shall share equally in the costs of the arbitration. The venue for any arbitration shall be in the State of Baja California.
Entire Agreement
These Terms and Conditions and any terms incorporated or referred to herein constitute the entire agreement between Medicina Mexico and you relating to your use of this Web Site and the subject matter hereof, and supersede any prior understandings or agreements (whether electronic, oral or written) regarding the subject matter, and may not be amended or modified except in writing, or by Medicina Mexico making such amendments or modifications in accordance with this Terms and Conditions of Use Agreement.
Severability
If any part of this Terms and Conditions of Use Agreement is deemed or determined to be unenforceable, then such part shall be eliminated or limited to the minimum extent necessary. The remainder of this Terms and Conditions of Use Agreement, including any revised portion, shall remain and be in full force and effect. This Terms and Conditions of Use Agreement are the entire agreement between us governing your use of this Web Site.

Force Majeure
Medicina Mexico shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including, without limitation, delays due to backorders of requested products, mail delays, customs delays or lost shipments. Medicina Mexico shall not be responsible to notify the Customer in the event of such delays. The Customer shall be solely responsible to make other arrangements to purchase alternative products and any costs incurred in connection with such purchases.
All parties hereby agree to the terms and conditions herein set.
End of Agreement
